
किसी criminal case में सबसे पहली practical गलती अक्सर यहीं होती है कि आरोपी यह तय करने से पहले कि उसे Regular Bail चाहिए या Anticipatory Bail, केवल FIR में लगी धाराओं को देखकर bail application की तैयारी शुरू कर देता है।
लेकिन bail का सवाल केवल offence की धारा देखकर तय नहीं होता।
सबसे पहले यह देखना पड़ता है कि आरोपी की procedural position क्या है—क्या उसे गिरफ्तार किया जा चुका है, क्या वह custody में है, या उसे अभी गिरफ्तारी की वास्तविक आशंका है?
यही distinction Regular Bail और Anticipatory Bail के बीच मूल अंतर पैदा करता है।
वर्तमान कानून में इसका statutory framework Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) में है। Section 478 bailable offences से संबंधित है, Section 480 non-bailable offences में bail का framework देता है, Section 482 उस व्यक्ति के लिए है जिसे non-bailable offence में गिरफ्तारी की आशंका है, जबकि Section 483 High Court और Court of Session की bail powers से संबंधित है।
इसलिए आसान भाषा में समझें तो सवाल यह नहीं है कि “कौन-सी bail ज्यादा अच्छी है?”
सही सवाल है—
“इस समय आरोपी किस स्थिति में है और कानून उस स्थिति में कौन-सा remedy उपलब्ध कराता है?”
Regular Bail और Anticipatory Bail क्या होती है?
Regular Bail का मतलब क्या है?
Regular Bail सामान्यतः उस स्थिति में relevant होती है जब आरोपी गिरफ्तार हो चुका हो या custody में हो और वह न्यायालय से अपनी रिहाई चाहता हो।
BNSS में bailable offence के लिए Section 478 एक अलग statutory framework देता है। यदि मामला non-bailable offence का है, तो Section 480 लागू होता है और High Court या Court of Session को Section 483 के तहत विशेष bail powers प्राप्त हैं।
यहाँ एक महत्वपूर्ण distinction समझना जरूरी है।
Non-bailable offence का अर्थ “जिसमें bail नहीं मिल सकती” नहीं है।
इसका अर्थ यह है कि bail केवल इस आधार पर automatic नहीं हो जाती कि आरोपी ने bail मांगी है; Court को applicable statutory conditions और case circumstances पर judicial consideration करना पड़ता है।
यही कारण है कि किसी व्यक्ति के गिरफ्तार होने के बाद उसकी पहली practical legal question अक्सर यह होती है कि—
- offence bailable है या non-bailable?
- उसे किस authority के सामने bail मांगनी है?
- custody की आवश्यकता prosecution किस आधार पर बता रही है?
- आरोपी की release पर कौन-सी conditions लग सकती हैं?
इन प्रश्नों के उत्तर के बाद Regular Bail की strategy बनती है।
Anticipatory Bail का मतलब क्या है?
Anticipatory Bail की स्थिति अलग है।
BNSS Section 482 उस व्यक्ति को remedy देता है जिसे reason to believe हो कि उसे किसी non-bailable offence के आरोप में गिरफ्तार किया जा सकता है। वह High Court या Court of Session में आवेदन कर सकता है और Court appropriate case में यह direction दे सकती है कि यदि उसे गिरफ्तार किया जाता है, तो उसे bail पर release किया जाए।
इसलिए anticipatory bail को केवल “FIR से पहले की bail” कहना सही नहीं होगा।
FIR दर्ज हो चुकी हो, investigation चल रही हो और आरोपी को अपनी गिरफ्तारी की वास्तविक apprehension हो—तब भी Section 482 का remedy relevant हो सकता है।
इसका वास्तविक purpose future arrest से पहले judicial protection प्राप्त करना है।
यहीं से दोनों remedies का सबसे सीधा अंतर सामने आता है:
Regular Bail में व्यक्ति custody के बाद release मांगता है; Anticipatory Bail में व्यक्ति संभावित arrest की स्थिति में पहले से protection मांगता है।
Regular Bail कब लेनी चाहिए?
Regular Bail का प्रश्न तब सामने आता है जब आरोपी की liberty पहले ही custody से प्रभावित हो चुकी हो।
यदि व्यक्ति गिरफ्तार हो चुका है, तो सामान्यतः अब यह कहना कि “मुझे arrest से पहले protection चाहिए” procedural position को ठीक से address नहीं करता। उस stage पर focus उसकी release from custody पर होता है।
लेकिन यहाँ भी एक ही formula हर case में लागू नहीं किया जा सकता।
Bailable offence और Regular Bail
यदि offence bailable है, तो BNSS Section 478 का statutory framework लागू होता है। Provision के अनुसार, जब eligible person bail देने को तैयार हो, तो उसे bail पर release किया जाना चाहिए, subject to the statutory framework and applicable exceptions.
इसलिए bailable offence में accused को केवल इसलिए unnecessary difficulty नहीं होनी चाहिए कि FIR में criminal sections लिखे हुए हैं।
यहाँ section का नाम नहीं, उसका classification महत्वपूर्ण है।
Non-bailable offence में क्या स्थिति है?
Non-bailable offence में स्थिति अलग है।
BNSS Section 480 Court को ऐसे cases में bail consider करने का framework देता है, जबकि Section 483 High Court और Court of Session को special bail powers देता है।
लेकिन इसका अर्थ यह नहीं कि serious allegation होने मात्र से bail स्वतः असंभव हो जाती है।
Court को case की statutory restrictions, accusation की nature, available material, accused की role, custody की आवश्यकता और applicable judicial principles को देखना पड़ता है।
यहीं defence को केवल यह argument नहीं रखना चाहिए कि—
“मेरे client को जेल में रखने की जरूरत नहीं है।”
उसे यह भी दिखाना पड़ता है कि क्यों custody अब investigation या trial के legitimate purpose के लिए necessary नहीं है, या applicable law के तहत release क्यों justified है।
यह difference एक मजबूत bail application और केवल formal bail application के बीच होता है।

Anticipatory Bail कब लेनी चाहिए?
Anticipatory Bail का सवाल तब आता है जब व्यक्ति अभी custody में नहीं है लेकिन उसे non-bailable offence में arrest होने की वास्तविक आशंका है।
Section 482 BNSS इसी situation को address करता है। Provision specifically “reason to believe” और apprehension of arrest की बात करता है।
इसका मतलब यह नहीं कि हर FIR में नाम आने वाला व्यक्ति automatically anticipatory bail का applicant बन जाए।
FIR में नाम आना और arrest की वास्तविक apprehension एक ही बात नहीं है
यह distinction practical litigation में बहुत महत्वपूर्ण है।
मान लीजिए किसी FIR में दस लोगों के नाम हैं। केवल नाम दर्ज होने से यह निष्कर्ष नहीं निकाला जा सकता कि सभी दस लोगों को तुरंत गिरफ्तार किया ही जाएगा।
दूसरी तरफ, यदि investigation की circumstances से यह दिख रहा है कि police आरोपी की custody चाहती है, notice के बावजूद arrest की संभावना बनी हुई है, या facts ऐसे हैं जिनसे liberty का immediate risk पैदा होता है, तब anticipatory bail का question genuinely arise कर सकता है।
इसलिए lawyer को FIR पढ़कर केवल sections की list नहीं बनानी चाहिए।
उसे यह पूछना चाहिए:
क्या arrest का खतरा वास्तविक है?
यही question anticipatory bail की necessity को समझने में ज्यादा महत्वपूर्ण है।
Anticipatory Bail कोई automatic protection नहीं है
Section 482 Court को यह power देता है कि appropriate case में, conditions के साथ, arrest होने की स्थिति में release का direction दिया जा सके।
इसका मतलब applicant को Court के सामने अपनी liberty का case judicially establish करना पड़ता है।
Court यह भी देख सकती है कि investigation में cooperation कैसे सुनिश्चित होगा और accused evidence या witnesses को influence तो नहीं करेगा।
इसलिए anticipatory bail application को केवल यह कहकर तैयार करना कि—
“मैं निर्दोष हूँ और मुझे falsely implicated किया गया है”
काफी नहीं होता।
Facts के अनुसार यह दिखाना पड़ता है कि custodial arrest की आवश्यकता क्यों नहीं है और applicant किस प्रकार investigation में cooperate करेगा।
यहीं Gurbaksh Singh Sibbia v. State of Punjab, (1980) 2 SCC 565 का constitutional significance सामने आता है। Supreme Court की Constitution Bench ने anticipatory bail को एक narrowly mechanical remedy की तरह नहीं देखा; इसका उद्देश्य personal liberty और criminal investigation के legitimate requirements के बीच judicial balance बनाना है।
इस principle का मतलब यह भी नहीं कि anticipatory bail हर accused का entitlement है। इसका मतलब यह है कि Court को application को केवल इस आधार पर reject नहीं करना चाहिए कि accusation serious है; उसे facts और circumstances के आधार पर statutory discretion exercise करनी होती है।
Regular Bail और Anticipatory Bail में असली अंतर क्या है?
अब दोनों remedies को एक साथ रखकर देखें।

इस table से एक बात साफ होनी चाहिए:
Regular Bail और Anticipatory Bail के बीच competition नहीं है।
दोनों अलग procedural situations के remedies हैं।
किसी व्यक्ति को कौन-सी bail चाहिए, यह इस बात से तय होता है कि उसकी liberty पर criminal process ने किस stage पर असर डाला है।
Court Anticipatory Bail देते समय किन बातों को देखती है?
यहाँ सबसे ज्यादा गलतफहमी होती है।
कई लोग मान लेते हैं कि anticipatory bail का पूरा मामला केवल यह साबित करने का है कि FIR झूठी है।
ऐसा नहीं है।
Court को facts के अनुसार कई competing considerations balance करने पड़ सकते हैं।
आरोप की प्रकृति और gravity
Allegation कितना गंभीर है, offence की statutory punishment क्या है और prosecution का case किस प्रकार का है—ये relevant factors हो सकते हैं।
लेकिन gravity अकेला निर्णायक factor नहीं है।
यदि केवल offence की maximum punishment देखकर हर anticipatory bail application reject कर दी जाए, तो Section 482 की judicial discretion practically meaningless हो जाएगी।
आरोपी की specific role
एक FIR में कई accused हो सकते हैं, लेकिन सभी की भूमिका समान नहीं होती।
किसी accused पर specific overt act है या केवल omnibus allegation है—यह difference bail stage पर relevant हो सकता है।
यही वह जगह है जहाँ defence को FIR, supporting material और investigation की current position को साथ पढ़ना चाहिए।
Investigation में cooperation
Anticipatory bail का मतलब investigation से immunity नहीं है।
Court appropriate conditions लगा सकती है ताकि accused investigation में available रहे और process को obstruct न करे।
Supreme Court के 2026 के एक anticipatory-bail order में भी protection को investigation में cooperation जैसी condition से जोड़ा गया और non-cooperation की स्थिति में State को cancellation के लिए trial court जाने की liberty दी गई।
इससे एक practical principle निकलता है:
Anticipatory bail का मजबूत defence “मैं investigation में cooperate नहीं करूंगा” नहीं हो सकता; बल्कि “custodial arrest के बिना investigation प्रभावी रूप से चल सकती है” होना चाहिए।
Witness या evidence को influence करने का risk
Court यह भी देख सकती है कि accused के बाहर रहने से prosecution evidence प्रभावित होने का वास्तविक risk है या नहीं।
इसलिए anticipatory bail के साथ conditions केवल formalities नहीं होतीं। उनका उद्देश्य investigation और trial की integrity को सुरक्षित रखना होता है।
Absconding या repeated offence का risk
यदि prosecution यह दिखाती है कि आरोपी के भागने, investigation से बचने या समान conduct दोहराने की वास्तविक संभावना है, तो Court उस aspect को भी consider कर सकती है।
लेकिन defence का काम केवल इन allegations को deny करना नहीं है। बेहतर strategy यह होती है कि facts और proposed conditions के माध्यम से Court को दिखाया जाए कि ऐसा risk manageable है।
एक महत्वपूर्ण बात: Anticipatory Bail का मतलब case जीतना नहीं है
यह distinction client को शुरुआत में ही समझाना जरूरी है।
Anticipatory bail मिलने का अर्थ यह नहीं कि Court ने accused को innocent घोषित कर दिया।
इसी तरह Regular Bail मिलने का अर्थ भी acquittal नहीं है।
Bail order liberty के बारे में होता है; criminal trial guilt या innocence के अंतिम determination के बारे में।
इसलिए bail मिलने के बाद भी accused को conditions का पालन करना, investigation/trial में उपस्थित रहना और prosecution process को obstruct न करना होता है।
यही कारण है कि bail को criminal case का final result नहीं, बल्कि criminal process के दौरान liberty को regulate करने वाला judicial mechanism समझना चाहिए।
2026 में Bail Law में कौन-सा development विशेष रूप से महत्वपूर्ण है?
Anticipatory bail को समझने के लिए 2026 का Sumit v. State of U.P., 2026 INSC 145 विशेष महत्व रखता है।
इस judgment में Supreme Court ने उस approach को correct किया जिसमें anticipatory bail protection को charge-sheet तक सीमित कर दिया गया था। Court ने स्पष्ट किया कि केवल charge-sheet filing या cognizance लेने से anticipatory bail protection अपने-आप समाप्त नहीं हो जाती; circumstances के अनुसार protection आगे भी जारी रह सकती है।
यह principle practical इसलिए महत्वपूर्ण है क्योंकि पुराने drafting habits में अभी भी कई बार यह मान लिया जाता है कि—
“Charge-sheet दाखिल = anticipatory bail खत्म.”
यह proposition अब इतना सरल नहीं है।
Supreme Court का approach यह है कि protection को केवल एक mechanical expiry date से नहीं देखा जा सकता; Court को case-specific circumstances और applicable conditions को देखना होगा।
इसी broader principle को Sushila Aggarwal v. State (NCT of Delhi), (2020) 5 SCC 1 में Constitution Bench ने पहले ही विकसित किया था—anticipatory bail को सामान्यतः arbitrary fixed period तक सीमित करना आवश्यक नहीं है और appropriate cases में यह trial तक continue कर सकती है, subject to the Court’s assessment and conditions.
इसलिए 2026 में भी anticipatory bail को केवल “कुछ दिनों की temporary protection” समझना सही legal approach नहीं होगा।
अगर व्यक्ति गिरफ्तार हो गया तो क्या Anticipatory Bail मांगी जा सकती है?
यहीं पर सबसे ज्यादा procedural confusion दिखाई देता है।
यदि किसी व्यक्ति को उसी offence में गिरफ्तार किया जा चुका है, तो सामान्य स्थिति में अब Section 482 BNSS की anticipatory bail उस arrest से बचाने का remedy नहीं रह जाती। Supreme Court ने इस principle को स्पष्ट रूप से कहा है कि जिस offence में व्यक्ति गिरफ्तार हो चुका है, उस offence के संबंध में उसे regular bail का रास्ता अपनाना होता है।
इसका practical मतलब बहुत सीधा है।
अगर आरोपी को पुलिस ने गिरफ्तार कर लिया है, तो अब defence को यह देखना होगा कि—
- offence bailable है या non-bailable;
- किस Court के सामने bail maintainable है;
- police custody मांगी जा रही है या judicial custody;
- prosecution custody की क्या आवश्यकता बता रही है;
- accused के खिलाफ material क्या है;
- और bail के लिए कौन-सी statutory restrictions लागू हैं।
यानी arrest के बाद strategy का centre “arrest रोकना” नहीं बल्कि “custody से release” हो जाता है।
हालाँकि एक महत्वपूर्ण nuance है। यदि व्यक्ति किसी दूसरे offence में custody में है, तो केवल उस custody के आधार पर हर दूसरे offence में anticipatory bail का रास्ता बंद नहीं हो जाता। Supreme Court ने इस distinction को भी recognise किया है। इसलिए किसी particular matter में FIRs, offences और custody orders को अलग-अलग देखना जरूरी है; केवल यह कहना कि “आरोपी जेल में है इसलिए anticipatory bail कभी नहीं हो सकती” भी technically सही नहीं होगा।
उत्तर प्रदेश में Regular और Anticipatory Bail कहाँ और कैसे ली जाती है?
उत्तर प्रदेश में bail litigation को समझने के लिए current BNSS framework को पुराने CrPC numbering से अलग रखना जरूरी है।
आज anticipatory bail का principal provision Section 482 BNSS है और High Court तथा Court of Session की special bail powers Section 483 BNSS में हैं। BNSS में arrested person को grounds of arrest और right to bail की जानकारी देने तथा 24-hour detention limit जैसे procedural safeguards भी अलग provisions में दिए गए हैं।
Practical level पर इसका मतलब यह है कि Uttar Pradesh में lawyer को पहले यह determine करना होता है कि मामला किस procedural stage पर है और किस forum से immediate relief realistically मांगी जा सकती है।
Anticipatory Bail के लिए
यदि accused अभी गिरफ्तार नहीं हुआ है और Section 482 BNSS की conditions के भीतर arrest की genuine apprehension है, तो application Court of Session या High Court के सामने maintainable हो सकती है।
Regular Bail के लिए
यदि accused custody में है, तो applicable circumstances के अनुसार Magistrate, Sessions Court या High Court के सामने regular bail का question उठता है।
Allahabad High Court के 2026 records यह भी दिखाते हैं कि Section 482 BNSS के तहत anticipatory-bail litigation अब नियमित रूप से Court के सामने आ रही है। जुलाई 2026 के official High Court records में अलग-अलग dates पर बड़ी संख्या में Criminal Misc. Anticipatory Bail Applications under Section 482 BNSS listed हैं।
इसी तरह June 2026 के official Allahabad High Court records में Section 482 BNSS anticipatory-bail applications के साथ-साथ regular bail applications भी दिखाई देती हैं।
इसका महत्व केवल इतना नहीं है कि “UP में bail cases बहुत आते हैं।”
असल practical point यह है कि forum selection और procedural stage को गलत समझकर filing करने से पहले ही defence कमजोर हो सकता है।
इसलिए client से सबसे पहला सवाल यह होना चाहिए:
“आप गिरफ्तार हैं, या अभी गिरफ्तारी की आशंका है?”
यही answer आगे की remedy को काफी हद तक निर्धारित करता है।
Special Act लगने पर Regular और Anticipatory Bail का पूरा equation कैसे बदल सकता है?
यह वह जगह है जहाँ किसी भी general bail article को सावधान रहना चाहिए।
BNSS का general bail framework महत्वपूर्ण है, लेकिन हर criminal case केवल BNSS से governed नहीं होता।
यदि किसी FIR में कोई special statute लागू है, तो उस कानून की specific bail restrictions पहले देखनी पड़ती हैं।
उदाहरण के लिए NDPS Act में Section 37 commercial quantity तथा कुछ specified offences के मामलों में bail के लिए stringent statutory conditions रखता है। Supreme Court ने 2026 में भी दोहराया कि जहाँ Section 37 की conditions लागू होती हैं, वहाँ Court को उन twin conditions पर specifically विचार करना आवश्यक है।
इसका मतलब यह है कि किसी lawyer का यह कहना कि—
“Non-bailable offence है, इसलिए Section 480 BNSS के सामान्य principles से bail मिल जाएगी”
हर case में पर्याप्त नहीं है।
Special Act का overriding या additional bail test देखना पड़ेगा।
इसी तरह PMLA, NDPS, SC/ST Act तथा अन्य special criminal statutes में अलग restrictions, jurisdictional rules या statutory bars हो सकते हैं। Supreme Court की अपनी case-classification system भी special criminal statutes के मामलों को अलग categories में track करती है—जैसे NDPS और money-laundering matters—जो इस बात का practical संकेत है कि special-law bail को ordinary bail litigation से mechanically equate नहीं किया जा सकता।
इसलिए किसी accused को यह सलाह देना कि “बस anticipatory bail लगा दीजिए” या “regular bail तो मिल ही जाएगी”, बिना FIR में लगे special statute को पढ़े, legally responsible approach नहीं है।
Regular Bail और Anticipatory Bail चुनने का सही Practical Framework क्या है?
अब पूरे discussion को एक practical decision tree में रखें।
स्थिति 1 — व्यक्ति गिरफ्तार नहीं हुआ है
सबसे पहले देखें:
क्या non-bailable offence में arrest की वास्तविक और legally sustainable apprehension है?
यदि हाँ, तो Section 482 BNSS के तहत anticipatory bail पर विचार किया जा सकता है।
लेकिन केवल FIR में नाम होना पर्याप्त factual analysis नहीं है। FIR की allegations, accused की specific role, investigation की stage और arrest-related circumstances को साथ देखना होगा।
स्थिति 2 — व्यक्ति गिरफ्तार हो चुका है
अब उसी offence में सामान्य route Regular Bail है।
यहाँ defence को custody की necessity, allegation की nature, evidence, accused की role, antecedents और applicable statutory restrictions पर काम करना चाहिए।
स्थिति 3 — offence bailable है
यहाँ Section 478 BNSS का statutory framework महत्वपूर्ण हो जाता है। Eligible person के लिए provision release on bail का framework देता है, subject to the statutory conditions.
स्थिति 4 — offence non-bailable है
यहाँ Section 480 और, appropriate cases में, Section 483 BNSS का framework relevant होगा।
लेकिन “non-bailable” को “non-bailable = no bail” समझना कानूनी गलती होगी।
स्थिति 5 — Special Act भी लगा है
तुरंत यह check करना होगा कि उस special statute में:
- अलग bail conditions हैं?
- anticipatory bail पर statutory restriction है?
- special Court designated है?
- prosecution को अलग threshold satisfy करना है?
- कोई statutory bar या heightened test है?
यहीं general bail formula टूट सकता है।
Regular Bail vs Anticipatory Bail: एक नजर में पूरी समझ

इस पूरी table का सबसे महत्वपूर्ण हिस्सा पहला column नहीं, बल्कि procedural stage है।
क्योंकि bail की सही strategy “कौन-सी bail ज्यादा powerful है” से नहीं निकलती।
वह इस सवाल से निकलती है:
“आज की तारीख में accused की liberty किस procedural threat के सामने खड़ी है?”
यदि threat arrest है और arrest अभी नहीं हुई—anticipatory bail का question।
यदि arrest हो चुकी है—regular bail का question।
यदि special statute है—पहले उस statute की restrictions।
यही सही sequence है।
Client को कौन-सी Bail चाहिए—एक lawyer कैसे तय करेगा?
किसी भी client की consultation में केवल FIR की copy देखकर सीधे bail application तैयार करना सही approach नहीं है।
पहले कम-से-कम ये facts establish होने चाहिए:
- FIR में कौन-कौन से offences लगाए गए हैं?
- उनमें से कौन bailable और कौन non-bailable है?
- कोई special Act invoke हुआ है या नहीं?
- आरोपी गिरफ्तार है या बाहर?
- यदि बाहर है, तो arrest apprehension किस factual material पर आधारित है?
- यदि गिरफ्तार है, तो police custody या judicial custody की वर्तमान स्थिति क्या है?
- आरोपी की FIR में specific role क्या है?
- कोई criminal antecedent है?
- Investigation किस stage पर है?
- क्या prosecution custody की कोई specific आवश्यकता बता रही है?
इन सवालों के बाद ही यह तय किया जा सकता है कि Regular Bail, Anticipatory Bail या किसी special statutory remedy में से कौन-सा रास्ता वास्तव में appropriate है।
यही वह point है जहाँ bail drafting और mere form-filling अलग हो जाते हैं।
निष्कर्ष: Regular Bail या Anticipatory Bail—कौन-सी सही है?
इस पूरे सवाल का कोई universal answer नहीं है।
लेकिन procedural distinction बिल्कुल स्पष्ट है।
यदि व्यक्ति गिरफ्तार नहीं हुआ है और non-bailable offence में arrest की वास्तविक apprehension है, तो Section 482 BNSS के तहत Anticipatory Bail पर विचार किया जाता है।
यदि व्यक्ति उसी offence में गिरफ्तार हो चुका है, तो सामान्य remedy Regular Bail होती है।
यदि offence bailable है, तो Section 478 BNSS का statutory framework लागू होता है।
यदि offence non-bailable है, तो Section 480 तथा appropriate cases में Section 483 BNSS के तहत judicial consideration होती है।
और यदि NDPS, PMLA, SC/ST Act या कोई अन्य special statute लागू है, तो सामान्य BNSS framework को mechanically apply नहीं किया जा सकता।
सबसे महत्वपूर्ण बात यह है कि Bail का चुनाव offence के नाम से कम और accused की procedural position से अधिक तय होता है।
2026 में भी Supreme Court का approach यह नहीं है कि liberty और investigation में से किसी एक को हमेशा चुन लिया जाए। Court का काम दोनों के बीच legally sustainable balance बनाना है। Anticipatory bail के संदर्भ में Gurbaksh Singh Sibbia की foundational approach और Sushila Aggarwal की continuing-protection principle इसी broader judicial framework का हिस्सा हैं; 2026 के decisions में भी investigation cooperation और case-specific conditions के साथ यही balancing exercise दिखाई देती है।
इसलिए किसी व्यक्ति के लिए सही legal question यह नहीं होना चाहिए—
“Regular Bail बेहतर है या Anticipatory Bail?”
सही सवाल है—
“मेरे मामले में अभी arrest से पहले protection चाहिए या arrest के बाद custody से release—और उस remedy पर कौन-सा statute तथा कौन-सी judicial restriction लागू होगी?”
यही distinction सही bail strategy की शुरुआत है।
Frequently Asked Questions
क्या FIR में नाम आने पर तुरंत Anticipatory Bail लेनी चाहिए?
हर case में नहीं। FIR में नाम आना और arrest की वास्तविक apprehension अलग questions हैं। FIR की allegations, accused की role, offence की nature और investigation की circumstances देखकर remedy तय करनी चाहिए।
क्या Non-Bailable Offence में Bail नहीं मिलती?
मिल सकती है। “Non-bailable” का अर्थ यह नहीं है कि bail legally prohibited है। इसका अर्थ है कि bail automatic statutory release की category में नहीं आती और applicable judicial discretion तथा restrictions के अनुसार decide होती है।
क्या Arrest के बाद Anticipatory Bail ली जा सकती है?
उसी offence में arrest हो जाने के बाद सामान्य remedy Regular Bail होती है। Supreme Court ने भी इस procedural distinction को स्पष्ट किया है।
क्या Anticipatory Bail मिलने के बाद Charge-sheet आते ही Bail खत्म हो जाती है?
सिर्फ charge-sheet filing या cognizance के कारण anticipatory protection को mechanically समाप्त मानना सही नहीं है। Sushila Aggarwal और 2026 के Sumit v. State of U.P. जैसे authorities इस क्षेत्र में महत्वपूर्ण हैं।
क्या Bail मिलने का मतलब आरोपी निर्दोष साबित हो गया?
नहीं। Bail order और final determination of guilt दो अलग judicial stages हैं।
क्या NDPS case में सामान्य bail rules लागू होते हैं?
BNSS का general framework अकेले पर्याप्त नहीं है। NDPS Act की Section 37 जैसी special restrictions applicable cases में additional hurdles पैदा करती हैं। Supreme Court ने 2026 में भी Section 37 की twin conditions के पालन को आवश्यक माना है।
