
ED की investigation चल रही है। किसी व्यक्ति का नाम PMLA case में आ गया है। कहीं ED ने arrest कर लिया है, कहीं prosecution complaint Special Court में दाखिल हो चुकी है, कहीं Court से summons आया है और कहीं आरोपी लंबे समय से custody में है।
इन सभी situations में सबसे पहला सवाल लगभग एक ही होता है—
“PMLA case में bail कैसे मिलेगी?”
लेकिन PMLA में इस सवाल का जवाब केवल Section 45 पढ़ लेने से नहीं मिलता।
पहले यह समझना पड़ता है कि आरोपी किस procedural stage पर है, Special Court के सामने मामला किस स्थिति में है और prosecution का असली आरोप क्या है। उसके बाद सवाल आता है कि alleged proceeds of crime क्या हैं, accused को उससे किस material के आधार पर जोड़ा गया है और Section 45 की कठोर शर्तें उस particular case में किस तरह लागू होती हैं।
यहीं से PMLA bail की वास्तविक कानूनी लड़ाई शुरू होती है।
PMLA Case में Bail की जरूरत कब पड़ती है? पहले अपनी Procedural Position समझिए
PMLA case में सबसे पहली गलती यही होती है कि हर situation को एक जैसा मान लिया जाए।
मान लीजिए किसी व्यक्ति के खिलाफ ED की investigation चल रही है, लेकिन उसे अभी arrest नहीं किया गया।
दूसरी स्थिति में ED ने Section 19 के तहत arrest कर लिया और वह custody में है।
तीसरी स्थिति में ED ने prosecution complaint Special Court के सामने दाखिल कर दी है और Court ने cognizance लेकर summons जारी कर दिया है।
चौथी स्थिति में आरोपी पहले से custody में है और regular bail की आवश्यकता पैदा हो चुकी है।
इन चारों स्थितियों में “bail कैसे मिलेगी” का procedural रास्ता बिल्कुल एक जैसा नहीं माना जा सकता।
यह distinction इसलिए भी महत्वपूर्ण है क्योंकि Supreme Court ने PMLA proceedings में complaint के बाद Court के सामने summons के compliance को अपने-आप ऐसी custody नहीं माना है जिसके कारण व्यक्ति को अनिवार्य रूप से bail application दाखिल करनी पड़े।
Tarsem Lal v. Directorate of Enforcement में Supreme Court ने PMLA complaint पर cognizance के बाद summons के माध्यम से Court के सामने उपस्थित होने वाले accused की स्थिति को अलग तरह से समझाया। केवल summons के compliance में appearance को custody मानकर उसे bail लेने के लिए मजबूर करना सही approach नहीं है।
इसलिए PMLA case में पहला सवाल कभी-कभी यह भी हो सकता है—
“क्या मुझे इस stage पर bail की आवश्यकता ही है, या Court में appearance का अलग procedural route उपलब्ध है?”
यही छोटा-सा distinction आगे की पूरी strategy बदल सकता है।
Special Court में PMLA Case कैसे आगे बढ़ता है? Complaint, Cognizance, Summons और Custody का संबंध समझिए
PMLA proceedings को सामान्य police-case की तरह सीधे—
FIR → arrest → chargesheet → bail
वाले रास्ते से समझना कई बार misleading हो सकता है।
PMLA में prosecution complaint और Special Court की भूमिका का अपना statutory framework है।
PMLA की Section 44 के अनुसार money-laundering offence की complaint Special Court के सामने जाती है और उसी Special Court के सामने proceedings आगे बढ़ती हैं। PMLA की Section 46 criminal procedure के provisions को उस सीमा तक लागू करती है जहाँ वे PMLA से inconsistent न हों।
Current 2026 position में इस procedural framework को पुराने CrPC references के साथ mechanically नहीं पढ़ना चाहिए। Supreme Court ने 2026 में Parvinder Singh v. Directorate of Enforcement में PMLA Special Court और applicable procedural framework को current BNSS व्यवस्था के साथ भी examine किया है।
इसलिए practical sequence को इस तरह समझना ज्यादा सही है—
ED Investigation
↓
Section 19 के तहत arrest हुआ या नहीं
↓
Prosecution Complaint
↓
Special Court द्वारा cognizance
↓
Summons / appearance
↓
यदि custody legally arise होती है तो bail का प्रश्न
यहाँ एक और महत्वपूर्ण बात है।
PMLA में bail application किसी एक fixed procedural moment तक सीमित नहीं है। Supreme Court ने यह भी स्पष्ट किया है कि Section 45 में ऐसा कोई fixed stage नहीं है जो यह कहे कि complaint दाखिल होने के बाद ही bail मांगी जा सकती है या charge frame होने के बाद ही। Bail application को relevant stage पर Section 45 के parameters के भीतर examine किया जा सकता है।
इसलिए किसी PMLA accused की bail strategy बनाते समय केवल “chargesheet/complaint दाखिल हुई या नहीं” पूछना पर्याप्त नहीं है।
पहले यह देखना होगा कि व्यक्ति की वर्तमान procedural position क्या है।
लेकिन PMLA में Bail इतनी कठिन क्यों मानी जाती है? — Section 45 की असली भूमिका
अब उस statutory provision पर आते हैं जिसकी वजह से PMLA bail सामान्य bail से अलग दिखाई देती है—
Section 45 of the Prevention of Money-Laundering Act, 2002.
Section 45 PMLA offences को cognizable और non-bailable framework में रखती है और bail के लिए एक अतिरिक्त statutory test लगाती है।
इसमें दो अलग stages समझना जरूरी है।
पहले—
Public Prosecutor को bail application oppose करने का opportunity दिया जाता है।
और यदि prosecution bail का विरोध करती है, तब Court को Section 45 की दूसरी requirement पर जाना पड़ता है।
वहाँ Court को दो बातों पर satisfaction बनानी होती है—
- Court के पास reasonable grounds हों कि accused उस offence का guilty नहीं है; और
- release होने के बाद accused के किसी offence में involved होने की संभावना नहीं है।
यही Section 45 की famous twin conditions हैं।
Supreme Court ने 2025 में फिर स्पष्ट किया कि इन दोनों conditions पर Court का विचार करना mandatory है। केवल सामान्य bail considerations लिखकर Section 45 की statutory requirements को bypass नहीं किया जा सकता।
इसका practical अर्थ बहुत महत्वपूर्ण है।
यदि prosecution Section 45 invoke कर रही है, तो Defence को भी अपने arguments को उसी statutory framework के भीतर बनाना पड़ेगा।
सिर्फ—
“Accused काफी समय से custody में है।”
या—
“Accused respectable person है।”
या—
“Investigation पूरी हो चुकी है।”
जैसे सामान्य grounds अपने-आप Section 45 की पहली condition को satisfy नहीं करते।
पहले Court को यह दिखाना होगा कि available material के आधार पर reasonable grounds कैसे बनते हैं कि accused money-laundering offence का guilty नहीं है।
और उसके बाद दूसरी condition—
release के बाद offence repeat करने की वास्तविक संभावना क्यों नहीं है।
यहीं से PMLA bail ordinary bail से अलग हो जाती है।
Section 45 की पहली शर्त — “Reasonable Grounds for Believing” का Court में असली मतलब क्या है?
यहीं सबसे ज्यादा confusion होता है।
Section 45 यह नहीं कहती कि bail लेने वाले accused को trial से पहले अपनी complete innocence prove करनी होगी।
लेकिन यह भी नहीं कहती कि Court केवल FIR या ED की complaint पढ़कर prosecution की हर allegation को proved मान ले।
तो फिर Court देखती क्या है?
Supreme Court की jurisprudence के अनुसार bail stage पर Court को पूरे trial की तरह evidence का final adjudication नहीं करना है। “Reasonable grounds” का assessment available material और उस material से निकलने वाली prima facie probability पर किया जाता है।
अर्थात Court को यह नहीं तय करना कि—
“आखिरकार conviction होगी या acquittal?”
यह trial का प्रश्न है।
Bail stage पर Court को इससे पहले का सवाल देखना है—
“क्या available material को देखते हुए ऐसी reasonable basis दिखाई देती है जिससे accused की guilt अभी prima facie sufficiently established नहीं लगती?”
यही कारण है कि Section 45 की पहली condition को समझते समय दो extremes से बचना जरूरी है।
पहला extreme:
“PMLA case है, इसलिए accused को अपनी innocence पूरी तरह साबित करनी होगी।”
यह सही approach नहीं है।
दूसरा extreme:
“Bail stage है, इसलिए Court evidence को देख ही नहीं सकती।”
यह भी सही नहीं है।
Court available material देखती है, लेकिन mini-trial नहीं करती।
यही distinction Supreme Court ने PMLA bail jurisprudence में बार-बार बनाए रखा है।
इसलिए Defence की drafting में केवल यह लिखना कि—
“Applicant is innocent and has been falsely implicated”
बहुत कम है।
बेहतर सवाल है—
Prosecution के अपने material में ऐसी कौन-सी factual या legal weakness है जिससे Section 45 की पहली condition पर reasonable satisfaction बन सकती है?
और यह सवाल हमें PMLA के सबसे महत्वपूर्ण concept तक ले जाता है—
Proceeds of Crime.
PMLA में असली लड़ाई Section 45 से पहले Proceeds of Crime पर क्यों होती है?
PMLA में “money laundering” को केवल इस रूप में नहीं समझा जा सकता कि किसी व्यक्ति के पास unexplained पैसा मिला और इसलिए PMLA लग गया।
कानून की structure में एक महत्वपूर्ण chain है:
Scheduled Offence
↓
Criminal activity से प्राप्त Proceeds of Crime
↓
उस proceeds से जुड़ी property / money
↓
Section 3 में described process or activity
↓
Accused का alleged role
इसी chain को समझे बिना Section 45 की पहली condition को properly argue करना मुश्किल हो सकता है।
PMLA की Section 2(1)(u) में “proceeds of crime” को scheduled offence से जुड़ी criminal activity से directly या indirectly derived/obtained property के रूप में define किया गया है।
इसलिए Defence के लिए केवल यह कहना पर्याप्त नहीं कि—
“मेरे client के पास पैसा नहीं था।”
कई cases में prosecution का allegation यह हो सकता है कि पैसा किसी और source से generate हुआ और accused ने बाद में उसे knowingly conceal, possess, acquire, use, project या claim किया।
इसलिए असली courtroom question और गहरा है—
जिस property या money को ED proceeds of crime बता रही है, उसका scheduled offence से legal connection क्या है और accused का उस proceeds से Section 3 के अर्थ में connection किस material से established किया जा रहा है?
यही वह point है जहाँ Section 45 की पहली condition practically test होती है।
और यहीं एक और important distinction समझना होगा।
“Unexplained” और “proceeds of crime” एक ही legal expression नहीं हैं।
किसी transaction का unexplained होना prosecution के लिए relevant circumstance हो सकता है, लेकिन PMLA allegation को आगे ले जाने के लिए statutory ingredients और accused-specific connection को भी examine करना पड़ता है।
क्या Unaccounted Money या Suspicious Transaction अपने-आप “Proceeds of Crime” बन जाता है?
यह प्रश्न Lucknow में PMLA litigation के लिए खास महत्व रखता है।
Abbas Ansari v. Directorate of Enforcement, Neutral Citation 2024:AHC-LKO:35793, में Allahabad High Court, Lucknow Bench के सामने यही broader issue आया था।
Defence की ओर से यह argument रखा गया कि applicant के accounts में money movement या unexplained transactions को केवल इस आधार पर proceeds of crime नहीं माना जा सकता और applicant को alleged predicate offence से भी directly connect नहीं किया गया था।
लेकिन Court ने केवल Defence की characterization स्वीकार नहीं की।
Court ने record में alleged money trail, firms से funds के movement, flow charts, applicant के accounts और prosecution द्वारा बताए गए transactions को भी देखा। Court ने यह पाया कि available material से applicant को alleged movement and trail of funds से जोड़ने वाला material मौजूद था और Section 45 की required prima facie satisfaction नहीं बन रही थी।
अंततः bail reject हुई।
यह order इसलिए महत्वपूर्ण है क्योंकि इससे दोनों पक्षों की legal strategy समझ आती है।
Defence का सही सवाल:
“क्या unexplained transaction को केवल suspicious मानकर proceeds of crime कहा जा सकता है?”
Prosecution का counter:
“यह केवल unexplained transaction नहीं है; investigation ने funds का origin, movement और accused तक उसका trail दिखाया है।”
और फिर Defence को दूसरा सवाल पूछना पड़ेगा:
“उस alleged trail में scheduled offence से पैदा हुए proceeds और accused की Section 3 वाली alleged activity के बीच actual legal link कहाँ है?”
यही courtroom-level distinction है।
इसलिए article में यह कहना गलत होगा कि—
“Unaccounted money कभी PMLA proceeds नहीं बन सकता।”
सही बात यह है:
Unaccounted या suspicious money को proceeds of crime मानने के लिए prosecution की पूरी statutory chain को देखना होगा—scheduled offence, उससे जुड़ी criminal activity, alleged proceeds और accused की Section 3 में बताई गई activity के बीच connection।
और यदि prosecution के पास इस chain को जोड़ने वाला documentary या transactional material मौजूद है, तो केवल “money unexplained है” कहकर bail नहीं निकलेगी।
यही कारण है कि PMLA bail में money trail की quality कई बार case की सबसे निर्णायक चीज बन जाती है।
अगर आरोपी Scheduled Offence में सीधे Accused नहीं है, तो क्या PMLA में Bail का आधार बन सकता है?
यहाँ भी एक बहुत common misunderstanding है।
कई बार Defence यह argument करता है—
“मेरा नाम predicate/scheduled offence में नहीं है, इसलिए मेरे खिलाफ PMLA case ही नहीं बन सकता।”
यह proposition इतना absolute नहीं है।
PMLA jurisprudence यह मानती है कि Section 3 के offence के लिए हर बार यह जरूरी नहीं कि जिस व्यक्ति पर money laundering का आरोप है, वही व्यक्ति scheduled offence में भी accused हो।
उदाहरण के लिए, यदि कोई व्यक्ति scheduled offence में directly involved नहीं था, लेकिन बाद में knowingly उस offence से निकले proceeds को conceal करने, possess करने, use करने या किसी अन्य prohibited process/activity में assist करता है, तो केवल predicate offence में उसका नाम न होना अपने-आप Section 3 को खत्म नहीं करता।
इसलिए Defence को इससे ज्यादा precise question पूछना चाहिए—
पहला सवाल:
Scheduled offence कौन-सा है?
दूसरा:
उस scheduled offence से कौन-सी property proceeds of crime के रूप में identify की गई है?
तीसरा:
उस property का accused से actual connection क्या है?
चौथा:
Accused ने Section 3 में described कौन-सा process/activity allegedly किया?
पाँचवाँ:
क्या prosecution के पास उस specific role को support करने वाला material है या केवल association, family relationship, business connection या transaction की proximity है?
यही difference बहुत महत्वपूर्ण है।
क्योंकि केवल यह कहना—
“मैं predicate offence में accused नहीं हूँ”
काफी नहीं।
लेकिन दूसरी तरफ prosecution भी केवल यह कहकर नहीं रुक सकती कि—
“उसका नाम predicate FIR में नहीं है, फिर भी PMLA में accused है, इसलिए Section 3 automatically बनता है।”
उसे अपने आरोप की statutory chain दिखानी होगी।
यही वह जगह है जहाँ Section 45 की पहली condition वास्तव में accused-specific analysis बन जाती है।
और यही वजह है कि PMLA bail application में केवल पूरे case को “false case” बताने के बजाय Defence को यह identify करना चाहिए कि proceeds of crime और accused के alleged laundering activity के बीच prosecution की chain में वास्तविक legal gap कहाँ है।
यहीं से अगला सवाल पैदा होता है—
अगर पहली twin condition पर Defence को अपनी जगह बनानी है, तो Section 45 की दूसरी condition—release के बाद accused के फिर किसी offence में शामिल होने की संभावना—को Court कैसे देखती है?
उसे अलग से समझना जरूरी है।
Section 45 की दूसरी शर्त — Bail पर आने के बाद आरोपी के फिर अपराध करने की संभावना Court कैसे देखती है?
Section 45 की पहली शर्त में Court यह देखती है कि available material के आधार पर accused के guilty न होने के reasonable grounds हैं या नहीं।
लेकिन केवल पहली condition पर बात खत्म नहीं होती।
दूसरी condition अलग सवाल पूछती है—
अगर accused को release किया गया, तो क्या उसके फिर किसी offence में involved होने की reasonable possibility है?
इसका मतलब यह नहीं है कि Court को केवल इसलिए bail रोक देनी चाहिए क्योंकि prosecution ने accused के खिलाफ कोई गंभीर allegation लगाया है।
Court को record की circumstances देखनी होती हैं।
उदाहरण के लिए:
- accused का previous criminal conduct क्या है;
- alleged offence में उसकी specific role क्या बताई गई है;
- क्या release के बाद witnesses को influence करने का वास्तविक आधार है;
- क्या evidence tamper करने की कोई वास्तविक संभावना है;
- क्या accused investigation या trial में cooperate करता रहा है;
- और क्या ऐसी कोई circumstance है जिससे यह reasonable apprehension बनती है कि release के बाद वह फिर उसी तरह की criminal activity में शामिल हो सकता है।
यहीं Defence को एक महत्वपूर्ण गलती से बचना चाहिए।
केवल यह कहना कि—
“Applicant का कोई criminal history नहीं है”
दूसरी condition को address करने के लिए useful हो सकता है, लेकिन यदि prosecution के पास accused के conduct या alleged network से जुड़ी specific material circumstances हैं, तो Court उन्हें भी देख सकती है।
दूसरी तरफ prosecution भी केवल—
“Economic offence serious है”
कहकर इस condition को अपने-आप satisfied नहीं मान सकती।
Seriousness और likelihood of re-offending एक ही legal question नहीं हैं।
यही distinction bail hearing में महत्वपूर्ण हो जाता है।
और अब PMLA bail की अगली बड़ी constitutional layer सामने आती है।
अगर आरोपी पहले से custody में है, तो सवाल यह भी होगा कि उस custody की शुरुआत ही कानून के अनुसार हुई थी या नहीं।
ED ने Arrest किया है तो Grounds of Arrest में कमी PMLA Bail को कैसे बदल सकती है?
PMLA में ED को Section 19 के तहत arrest की statutory power दी गई है, लेकिन यह power constitutional safeguards से बाहर नहीं है।
इसलिए arrest के बाद Defence को केवल यह नहीं देखना चाहिए कि—
“Arrest memo बना या नहीं?”
बल्कि यह भी देखना पड़ सकता है कि accused को arrest के grounds of arrest किस तरह और किस समय communicate किए गए।
Supreme Court ने Pankaj Bansal v. Union of India में grounds of arrest की meaningful communication को महत्वपूर्ण constitutional safeguard माना। बाद के judgments में इसी principle को और विकसित किया गया।
फिर Prabir Purkayastha में Supreme Court ने arrest के grounds की communication को Article 22(1) के protection से जोड़ा।
PMLA context में इसका महत्व और बढ़ जाता है।
क्यों?
क्योंकि Section 45 की पहली condition पर Defence को prosecution के material को challenge करना होता है। यदि accused को यह ही स्पष्ट रूप से पता न हो कि उसके खिलाफ arrest का वास्तविक आधार क्या है, तो effective legal challenge प्रभावित हो सकता है।
लेकिन यहाँ भी एक जरूरी caution है।
हर defect को illegal arrest नहीं कहा जा सकता।
Court को देखना होगा कि constitutional requirement वास्तव में किस तरह violate हुई और उसका legal consequence क्या है।
यही distinction Supreme Court के Directorate of Enforcement v. Subhash Sharma, 2025 INSC 141 में महत्वपूर्ण बना। वहाँ High Court ने arrest को illegal माना था और उसी आधार पर bail दी थी। Supreme Court ने PMLA arrest की legality और constitutional safeguards के संदर्भ में matter को examine किया।
इससे Defence के लिए एक गंभीर legal route निकलता है:
यदि arrest स्वयं कानून और constitutional safeguards के विपरीत है, तो केवल Section 45 की कठोरता दिखाकर उस custody को वैध नहीं बनाया जा सकता।
लेकिन इसका उल्टा भी उतना ही महत्वपूर्ण है—
सिर्फ “grounds of arrest में defect है” लिख देना पर्याप्त नहीं।
Defence को actual arrest record, grounds communicated, timing और applicable constitutional requirement को सामने रखना होगा।
अगर ED ने Arrest ही नहीं किया और Special Court से Summons आया है, तो क्या Bail Application जरूरी है?
यह सवाल पहले procedural position में उठा था; अब उसका practical consequence समझिए।
मान लीजिए ED ने investigation के दौरान accused को arrest नहीं किया।
बाद में prosecution complaint Special Court में दाखिल हुई।
Court ने cognizance लिया और summons जारी किया।
अब accused Court में उपस्थित होता है।
क्या उसे उसी moment custody में लेकर regular bail application लगाने के लिए मजबूर किया जाएगा?
Tarsem Lal v. Directorate of Enforcement में Supreme Court ने इस स्थिति को अलग तरीके से समझाया। Court ने कहा कि complaint पर cognizance के बाद summons के compliance में उपस्थित होने वाले accused को केवल इस वजह से custody में लेकर bail की प्रक्रिया से गुजरने के लिए मजबूर नहीं किया जाना चाहिए। Section 88 के तहत bond का प्रश्न भी अलग से relevant हो सकता है।
लेकिन यहाँ एक महत्वपूर्ण nuance है।
Tarsem Lal का मतलब यह नहीं कि PMLA में Section 45 कभी लागू नहीं होगा।
Supreme Court ने उसी judgment में यह भी स्पष्ट किया कि जहाँ accused bail application करता है, वहाँ Section 45 की conditions relevant हो सकती हैं; और Section 45 की rigours को procedural label बदलकर समाप्त नहीं किया जा सकता।
इसलिए practical lesson यह है:
Summons stage और custody stage को एक जैसा मत समझिए।
यही distinction किसी PMLA accused के लिए पहली procedural mistake और सही legal strategy के बीच फर्क कर सकती है।
क्या महिला, Sick/Infirm या ₹1 Crore से कम वाले मामलों में Section 45 अलग तरह से लागू होती है?
Section 45 में कुछ categories के लिए statutory proviso है।
इसमें broadly—
- woman;
- person who is sick or infirm;
- और prescribed monetary threshold से जुड़े cases
के लिए अलग consideration की गुंजाइश दी गई है।
लेकिन इसे automatic bail provision समझना गलत होगा।
“Woman है, इसलिए bail मिल जाएगी” या “sick है, इसलिए Section 45 लागू नहीं होगी”—ऐसा कोई blanket rule नहीं है।
Court को facts और statutory proviso की applicability देखनी होती है।
Lucknow Bench का Atif Raza v. Directorate of Enforcement, Neutral Citation 2025:AHC-LKO:9160, इसका अच्छा practical example है।
उस मामले में applicant serious cancer से treatment ले रहा था, medical records Court के सामने थे, Medical Board ने condition और treatment confirm किया था और prosecution ने भी medical condition तथा treatment को dispute नहीं किया। Court ने Section 45 के proviso में “sick or infirm” category को relevant मानते हुए medical grounds पर regular bail दी।
लेकिन यहाँ भी case का वास्तविक lesson यह नहीं है कि—
“बीमारी = PMLA bail।”
सही lesson है:
जब statutory proviso किसी particular circumstance को recognise करता है, तो Defence को उस circumstance को credible medical/legal material से establish करना पड़ता है।
लंबी Custody हो गई है तो क्या Section 45 के बावजूद PMLA में Bail मिल सकती है?
अब हम PMLA bail के सबसे महत्वपूर्ण constitutional सवाल पर आते हैं।
मान लीजिए Section 45 की statutory difficulty मौजूद है।
लेकिन आरोपी वर्षों से custody में है।
Trial शुरू नहीं हुआ।
या शुरू तो हुआ है लेकिन evidence की volume इतनी बड़ी है कि completion निकट भविष्य में दिखाई नहीं देती।
क्या केवल Section 45 के नाम पर pre-trial custody अनिश्चितकाल तक चल सकती है?
नहीं।
लेकिन इसका अर्थ यह भी नहीं कि किसी fixed number of months के बाद bail automatically मिल जाती है।
यहाँ Article 21 सामने आता है।
Supreme Court ने Manish Sisodia, Prem Prakash, Udhaw Singh और बाद के cases में repeatedly यह principle develop किया है कि stringent bail provision constitutional liberty को ऐसी indefinite pre-trial detention का आधार नहीं बना सकती जो reasonable time में trial होने की संभावना ही खत्म कर दे।
2025 के Mahesh Joshi v. Directorate of Enforcement, 2025 INSC 1377 में Supreme Court ने विशेष रूप से कहा कि Section 45(1)(ii) को voluminous, document-heavy cases में indefinite detention justify करने के लिए नहीं पढ़ा जा सकता जहाँ trial reasonable time में conclude होने की संभावना नहीं है।
यहाँ Defence को केवल custody period बताना पर्याप्त नहीं है।
Court के सामने पूरा picture रखना होगा:
कितने समय से custody है?
Trial किस stage पर है?
कितने witnesses हैं?
Documents कितने हैं?
Evidence already seized है या नहीं?
Accused ने proceedings delay की हैं या नहीं?
Prosecution realistically कितने समय में evidence complete कर सकती है?
यानी—
Long custody + serious delay + large volume of evidence + no realistic prospect of early conclusion
का combined constitutional picture ज्यादा महत्वपूर्ण है।
Supreme Court का 2026 का Rahul Parashar Order क्या बताता है?
यह current article के लिए खास तौर पर relevant है क्योंकि मामला Lucknow ED PMLA case से ही जुड़ा था।
Rahul Parashar v. Union of India, 7 January 2026 में Supreme Court के सामने उसी ECIR/LKZO/39/2023 से जुड़े regular bail matters आए।
Record के अनुसार appellants दो साल छह महीने से अधिक custody में थे, prosecution ने 41 witnesses cite किए थे और trial अभी शुरू ही हुआ था।
ED ने Section 45 की rigours पर reliance किया।
फिर भी Supreme Court ने देखा कि trial reasonable time में complete होने की संभावना नहीं है और appellants को bail grant की।
इस order का सबसे महत्वपूर्ण point यह नहीं है कि—
“2.5 years = automatic bail।”
ऐसा कोई rule Supreme Court ने नहीं बनाया।
असल point यह है:
Section 45 mandatory होने के बावजूद Court यह नहीं भूल सकती कि व्यक्ति अभी trial का सामना कर रहा है, conviction नहीं भुगत रहा।
यदि trial की वास्तविक timeline इतनी लंबी हो जाए कि custody practically punishment जैसी दिखाई देने लगे, तो Article 21 का constitutional dimension सामने आता है।
Lucknow में PMLA Bail के मामलों में Allahabad High Court ने किन परिस्थितियों को देखा है?
अब तक हमने अलग-अलग legal principles establish किए हैं।
अब Lucknow Bench के decisions को एक साथ देखने पर picture ज्यादा साफ होती है।
Meera Srivastava — prolonged incarceration का मजबूत example
Meera Srivastava v. Enforcement Directorate, Neutral Citation 2025:AHC-LKO:31024, में applicant 20 October 2021 से custody में थी।
Court के सामने undisputed circumstances में:
- तीन वर्ष से अधिक incarceration;
- लगभग 90 scheduled-offence FIRs;
- 225 से अधिक witnesses;
- evidence of even a single witness had not concluded;
- trial के निकट भविष्य में conclude होने की संभावना नहीं थी।
ED ने Section 45 और applicant से जुड़े financial transactions तथा company role पर reliance किया।
फिर भी Lucknow Bench ने prolonged incarceration, trial की स्थिति और surrounding circumstances को देखते हुए bail grant की। Court ने merits पर final finding देने के बजाय constitutional custody issue को महत्व दिया।
यहाँ एक senior-lawyer observation महत्वपूर्ण है:
Court ने यह नहीं कहा कि prosecution का case false है।
Court ने कहा, essentially, कि इतने लंबे pre-trial incarceration और trial की ऐसी स्थिति में custody को indefinitely continue करना उचित नहीं था।
यह distinction बहुत महत्वपूर्ण है।
David Mario Denis — जब prosecution material मजबूत दिखाई दे तो क्या होता है?
दूसरी तरफ केवल यह दिखाना कि PMLA case लंबा है या co-accused को relief मिला है, हमेशा पर्याप्त नहीं।
David Mario Denis v. Union of India, ECIR/LKZO/39/2023 से जुड़ा matter, 24 September 2025 को Allahabad High Court के सामने था।
Prosecution case में scheduled offences से जुड़े financial transactions, communications और alleged illegal gains की investigation material पर reliance था। Court ने applicant के role और available material को examine किया।
इस matter को article में एक important counter के रूप में रखना चाहिए:
PMLA bail में Court केवल custody की length नहीं देखती; prosecution की case-strength भी देखती है।
और यही कारण है कि Meera Srivastava और David Mario Denis को एक ही formula से पढ़ना गलत होगा।
PMLA Bail में ED क्या Counter करती है और Defence को उसका जवाब कहाँ बनाना पड़ता है?
अब पूरे article का courtroom test यहाँ आता है।
ED कहती है:
“Section 45 लागू है और दोनों conditions satisfy नहीं होतीं।”
Defence का सही जवाब:
“Section 45 लागू होने से statutory test समाप्त नहीं होता। Court को available material के आधार पर यह देखना है कि first condition पर reasonable grounds क्यों नहीं बन सकते।”
ED कहती है:
“Money trail accused तक पहुँचता है।”
Defence पूछता है:
“उस trail में scheduled offence से alleged proceeds of crime का legal nexus और accused की specific Section 3 activity कहाँ establish होती है?”
ED कहती है:
“Accused ने funds receive/use/transfer किए।”
Defence:
“क्या केवल receipt या transaction sufficient है, या prosecution ने यह भी दिखाया है कि accused को proceeds के criminal origin और alleged laundering activity का legally relevant connection था?”
यहाँ facts matter करेंगे।
ED कहती है:
“Accused को release किया तो वह evidence influence कर सकता है।”
Defence:
“Specific material क्या है? Evidence already seized है या नहीं? Witnesses पर influence की वास्तविक possibility क्या है? Accused ने investigation/trial में cooperation किया है या नहीं?”
ED कहती है:
“Economic offence गंभीर है।”
Defence:
“Seriousness अपनी जगह है, लेकिन Section 45 की statutory conditions और Article 21 की constitutional guarantee दोनों को Court को balance करना है।”
ED कहती है:
“Section 45 के कारण bail नहीं दी जा सकती।”
Defence:
“Section 45 mandatory है, लेकिन यदि arrest itself constitutionally vitiated है या prolonged custody में trial reasonable time में पूरा होने की वास्तविक संभावना नहीं है, तो constitutional courts Article 21 के तहत intervention कर सकती हैं।”
यही counter और anti-counter है।
Defence को prosecution के हर argument का केवल denial नहीं करना है।
उसे यह दिखाना है कि prosecution की बात मान लेने के बाद भी कौन-सा legal question अभी unresolved रहता है।
यहीं अच्छी PMLA bail argument और सामान्य bail pleading में फर्क पैदा होता है।
तो PMLA Case में Bail कैसे मिलेगी? — Section 45 से Article 21 तक पूरा कानूनी जवाब
अब पूरे सवाल का सीधा जवाब सामने रखिए।
PMLA case में bail का कोई एक universal ground नहीं है।
सबसे पहले यह देखना होगा कि आरोपी की procedural position क्या है।
यदि ED ने arrest नहीं किया और complaint के बाद केवल summons आया है, तो Tarsem Lal के कारण यह अलग से देखना होगा कि क्या उस stage पर actual custody और bail की आवश्यकता पैदा हुई भी है।
यदि आरोपी custody में है, तो Section 45 की statutory conditions को address करना होगा।
पहली condition में Defence को यह दिखाने की कोशिश करनी होगी कि available material के आधार पर reasonable grounds बनते हैं कि accused guilty नहीं है।
इसके लिए केवल innocence का assertion पर्याप्त नहीं।
देखना होगा—
- scheduled offence क्या है;
- alleged proceeds of crime क्या हैं;
- उनका source और statutory nexus क्या है;
- accused को उस proceeds से किस material से जोड़ा गया है;
- Section 3 में accused की specific alleged activity क्या है;
- और prosecution की पूरी chain में वास्तविक legal weakness कहाँ है।
दूसरी condition में Court को यह देखना होगा कि release के बाद accused के फिर किसी offence में involved होने की reasonable possibility है या नहीं।
इसके बाद arrest की legality अलग से महत्वपूर्ण हो सकती है।
यदि Section 19 arrest में constitutional safeguards का गंभीर उल्लंघन हुआ है, तो उस issue का स्वतंत्र constitutional consequence हो सकता है। Subhash Sharma इसी broader principle को महत्वपूर्ण बनाता है।
यदि Section 45 के merits पर मामला कठिन है लेकिन accused अत्यधिक लंबे समय से custody में है और trial reasonable time में समाप्त होने की वास्तविक संभावना नहीं है, तो Article 21 अलग constitutional route खोल सकता है। Mahesh Joshi और January 2026 के Rahul Parashar order इस principle के recent illustrations हैं।
और यदि Section 45 का statutory proviso—जैसे sick or infirm category—facts पर लागू होता है, तो उसे भी अलग से examine करना होगा। Atif Raza में Lucknow Bench ने इसी medical ground पर bail दी थी।
इसलिए PMLA bail की सही strategy यह नहीं है कि कोई एक “technical loophole” खोज लिया जाए।
सही तरीका है—
पहले procedural stage पहचानिए।
फिर prosecution की money-laundering chain समझिए।
फिर Section 45 की दोनों conditions पर case-specific defence बनाइए।
फिर arrest की legality देखिए।
और यदि custody असाधारण रूप से लंबी हो चुकी है, तो Article 21 और realistic trial timeline को अलग constitutional issue के रूप में रखिए।
यही कारण है कि PMLA में bail कठिन है, लेकिन कानून में उसका रास्ता बंद नहीं है।
अंततः Court को यह तय करना होता है कि इस particular accused के particular record पर statutory restriction, prosecution material और constitutional liberty के बीच legal balance कहाँ बनता है।
और यही PMLA bail का वास्तविक कानूनी प्रश्न है।
कानूनी Disclaimer

Practical Legal Note
PMLA bail application को केवल “Section 45 की दो conditions पूरी हैं” लिखकर तैयार करना पर्याप्त नहीं हो सकता।
कई मामलों में पहले यह देखना पड़ता है कि accused की procedural position क्या है—क्या arrest हुआ है, prosecution complaint पर cognizance हो चुका है, summons के आधार पर appearance हो रही है या accused पहले से custody में है।
इसके बाद Defence को prosecution की money-laundering theory को समझना पड़ता है—alleged proceeds of crime क्या हैं, scheduled offence से उनका connection क्या बताया गया है और accused को Section 3 में alleged activity से किस material के आधार पर जोड़ा गया है।
यदि custody लंबे समय से चल रही है, तो trial की वास्तविक progress और Article 21 का constitutional aspect भी अलग से examine किया जा सकता है।
Lucknow में PMLA Bail और ED Cases में Advocate Manoj Sharma की Legal Practice
Lucknow में PMLA matter में bail की तैयारी केवल Section 45 की language दोहराने से नहीं होती। ED की prosecution theory और accused की actual procedural position को अलग-अलग समझना पड़ता है।
विशेष रूप से Defence के लिए यह देखना महत्वपूर्ण हो सकता है कि—
- ED ने arrest किया है या नहीं;
- arrest होने पर grounds of arrest किस प्रकार communicate किए गए;
- prosecution complaint Special Court में किस stage पर है;
- summons के आधार पर appearance हो रही है या accused custody में है;
- alleged proceeds of crime किस scheduled offence से जोड़े गए हैं;
- money trail में accused की specific role क्या बताई गई है;
- Section 45 की पहली और दूसरी condition को किस factual material के आधार पर address किया जा सकता है;
- और prolonged custody होने पर trial की वास्तविक स्थिति क्या है।
Advocate Manoj Sharma की Lucknow-based criminal-law practice में ऐसे matters को case-record और current judicial position के आधार पर examine करने पर focus रखा जाता है। PMLA matter में Supreme Court और Allahabad High Court/Lucknow Bench के relevant decisions को केवल citation के रूप में नहीं, बल्कि case के actual facts और procedural stage के साथ पढ़ना महत्वपूर्ण होता है।
यदि किसी matter में arrest की legality, proceeds of crime का alleged nexus, Section 45 की twin conditions, Special Court proceedings या prolonged incarceration जैसे specific issues सामने हों, तो bail strategy उसी particular record के आधार पर तैयार की जानी चाहिए।
किसी भी PMLA case में outcome की guarantee नहीं दी जा सकती; legal strategy उपलब्ध record और लागू कानून के आधार पर ही तय की जा सकती है।
PMLA Bail — Frequently Asked Questions
1. क्या PMLA case में bail के लिए हमेशा Section 45 की twin conditions पूरी करनी पड़ती हैं?
हर procedural situation को एक जैसा नहीं माना जा सकता। यदि accused custody में है और regular bail का प्रश्न है, तो Section 45 की statutory conditions महत्वपूर्ण होती हैं। लेकिन summons के माध्यम से Special Court के सामने appearance जैसी अलग procedural situations में Supreme Court ने अलग treatment बताया है।
2. क्या ED की complaint में नाम आने मात्र से आरोपी को bail के लिए Court में surrender करना पड़ता है?
हर case में ऐसा automatic rule नहीं है। यदि accused को investigation के दौरान arrest नहीं किया गया और complaint पर cognizance के बाद summons जारी हुआ है, तो Tarsem Lal के principles के अनुसार summons compliance और custody को अलग-अलग देखना पड़ सकता है।
3. क्या PMLA में “proceeds of crime” साबित किए बिना bail मिल सकती है?
Bail stage पर final proof की आवश्यकता trial की तरह नहीं होती, लेकिन Section 45 की first condition के लिए prosecution material और alleged proceeds of crime की statutory foundation महत्वपूर्ण हो सकती है। Defence यह examine कर सकता है कि scheduled offence, alleged proceeds और accused के बीच connection कितना prima facie established है।
4. क्या केवल unaccounted cash मिलने से PMLA लग जाता है?
केवल “unaccounted” होने और legally “proceeds of crime” होने को एक ही बात नहीं माना जा सकता। PMLA analysis में scheduled offence से statutory connection और alleged money-laundering activity को भी examine करना पड़ता है।
5. अगर मेरा नाम scheduled offence में नहीं है, तो क्या PMLA case खत्म हो जाता है?
नहीं। यह अपने-आप PMLA liability समाप्त करने वाला absolute rule नहीं है। Court यह देख सकती है कि accused को proceeds of crime और Section 3 में described activity से किस material के आधार पर जोड़ा गया है।
6. क्या Section 45 की “reasonable grounds” condition का मतलब है कि accused को trial से पहले अपनी innocence साबित करनी होगी?
नहीं। Bail stage पर Court को final guilt या innocence का determination नहीं करना होता। लेकिन Section 45 लागू होने पर Court को available material के आधार पर statutory satisfaction बनानी होती है। यही reason है कि Defence को केवल general denial के बजाय specific evidentiary weaknesses identify करनी पड़ती हैं।
7. क्या grounds of arrest ठीक से communicate न होने पर PMLA bail मिल सकती है?
यदि arrest की constitutional validity पर serious legal defect established होता है, तो उसका अलग constitutional consequence हो सकता है। लेकिन केवल यह allegation कर देना पर्याप्त नहीं कि “grounds properly नहीं दिए गए”; actual arrest record, communication और applicable Supreme Court principles को examine करना होगा।
8. क्या PMLA में लंबे समय तक जेल में रहने के बाद bail मिल सकती है?
Long custody अपने-आप automatic bail नहीं बनाती। लेकिन यदि custody बहुत लंबी हो गई हो, trial आगे नहीं बढ़ रहा हो और reasonable time में trial पूरा होने की संभावना न हो, तो Article 21 का constitutional consideration महत्वपूर्ण हो सकता है। Supreme Court ने ऐसे circumstances में Section 45 के साथ constitutional liberty को भी examine किया है।
9. क्या महिला आरोपी को PMLA में bail आसानी से मिल जाती है?
Section 45 में woman के लिए statutory proviso है, लेकिन यह automatic bail का अधिकार नहीं बनाता। Court को particular facts, allegations और statutory discretion के अनुसार decision लेना होता है।
10. क्या बीमारी के आधार पर PMLA में bail मिल सकती है?
Section 45 का proviso sick या infirm व्यक्ति के लिए अलग consideration प्रदान करता है। लेकिन medical condition को credible medical material से establish करना पड़ता है और Court circumstances के आधार पर discretion exercise करती है।
11. क्या Lucknow में किसी दूसरे PMLA accused को bail मिल गई हो तो मुझे भी parity पर bail मिल सकती है?
केवल दूसरी bail order दिखाना पर्याप्त नहीं। Court यह देख सकती है कि दोनों मामलों में role, money trail, evidence, custody period, procedural stage और अन्य material circumstances वास्तव में comparable हैं या नहीं।
12. PMLA bail के लिए कौन-से documents सबसे पहले lawyer को दिखाने चाहिए?
Matter की stage के अनुसार prosecution complaint, available ECIR-related documents, arrest memo, grounds of arrest, remand orders, Special Court orders, relevant scheduled-offence records, financial transaction material, previous bail orders और custody/trial record महत्वपूर्ण हो सकते हैं। Exact documents case-specific होंगे।
