मामला शुरू कैसे हुआ?
10 जनवरी 2024 की बात है।
पंजाब के Tarn Taran जिले में police checking चल रही थी। Canal Road के पास Village Veeram के नजदीक एक Mahindra XUV-300 को रोका गया।
गाड़ी में दो लोग थे—Gurjit Singh @ Geetu, जो vehicle चला रहा था, और Sukhwinder Singh @ Gora।
Police version के अनुसार vehicle की search में heroin के तीन packets मिले।
Sukhwinder Singh के कब्जे से 957 grams और Gurjit Singh के कब्जे से 508 grams heroin बरामद होने की बात prosecution ने कही।
दोनों को मिलाकर recovery 1.465 kilograms थी।
NDPS Act के तहत यह quantity commercial quantity थी।
यहीं से इस case की सबसे महत्वपूर्ण कानूनी दीवार खड़ी हो गई—Section 37 NDPS Act।
क्योंकि commercial quantity के मामले में सामान्य bail principles अकेले काम नहीं करते। Parliament ने bail के लिए अतिरिक्त statutory conditions लगा रखी हैं।
FIR / शुरुआती कार्यवाही में क्या हुआ?
Recovery के बाद FIR No. 06 of 2024, Police Station Khalra, District Tarn Taran में दर्ज हुई।
FIR में Sections 21(c) और 29 NDPS Act लगाए गए।
Section 21(c) commercial quantity से जुड़े manufactured drugs/preparations के offence से संबंधित है, जबकि Section 29 abetment और criminal conspiracy को cover करता है।
यहाँ prosecution का शुरुआती case सीधा था:
दो accused → vehicle → heroin recovery → commercial quantity → NDPS prosecution।
बाद की पूरी litigation recovery की final guilt तय करने के लिए नहीं थी।
असल लड़ाई धीरे-धीरे बदलकर इस सवाल पर आ गई:
“जब trial चल रहा है और accused लंबे समय से custody में है, तो commercial quantity NDPS case में bail किस legal test से दी जाएगी?”
यही सवाल बाद में High Court और Supreme Court के बीच मुख्य विवाद बना।
Investigation के बाद क्या हुआ?
Investigation के बाद prosecution ने 21 June 2024 को chargesheet दाखिल की।
इससे police investigation वाला stage खत्म हुआ और मामला trial की ओर बढ़ गया।
इसके बाद 20 July 2024 को Trial Court ने accused के खिलाफ Sections 21(c) और 29 NDPS Act के तहत charges frame किए।
इसका अर्थ महत्वपूर्ण है।
अब मामला केवल FIR या investigation stage पर नहीं था।
Charges formally frame हो चुके थे।
लेकिन trial की गति बाद में इस bail dispute की सबसे महत्वपूर्ण factual circumstance बनने वाली थी।
Trial Court में क्या हुआ?
यहाँ एक बात साफ रखना जरूरी है।
इस case में Trial Court ने कोई final conviction या acquittal नहीं दी थी।
मामला trial के दौरान bail litigation में Supreme Court तक पहुँचा।
20 July 2024 को charges frame होने के बाद prosecution ने evidence शुरू किया।
लेकिन Supreme Court के record के अनुसार जब High Court ने February 2026 में bail दी, तब 24 prosecution witnesses में से केवल 2 witnesses examine हुए थे।
यानी charges frame होने के बाद भी trial बहुत धीमी गति से आगे बढ़ रहा था।
यही तथ्य accused के लिए Article 21 का सबसे मजबूत practical argument बना।
Custody का सवाल इतना बड़ा कैसे बन गया?
Sukhwinder Singh 10 January 2024 से custody में था।
18 February 2026 को High Court ने जब bail पर विचार किया, तब लगभग दो साल से ज्यादा custody हो चुकी थी।
Charges July 2024 में frame हो चुके थे।
लेकिन prosecution evidence में केवल 2 of 24 witnesses examine हुए थे।
अब defence का सवाल था:
अगर trial इसी गति से चलता रहा तो accused को बिना conviction के कितने समय तक जेल में रहना पड़ेगा?
यहीं से Article 21 सामने आया।
लेकिन दूसरी तरफ State के पास Section 37 था।
इसलिए यह सामान्य bail application नहीं रह गई थी।
यह बन गया:
Liberty vs statutory restriction.
पहली Bail Application में क्या हुआ?
Sukhwinder Singh ने High Court के सामने पहले भी regular bail मांगी थी।
उसकी पहली bail petition थी:
CRM-M No. 58082 of 2025
यह petition 27 October 2025 को withdrawn कर दी गई।
इसके बाद accused ने दूसरी regular bail petition दाखिल की:
CRM-M No. 70945 of 2025।
यहीं से आगे का मामला technically महत्वपूर्ण हो जाता है।
क्योंकि दूसरी bail petition का मतलब केवल यह नहीं होता कि accused दोबारा वही arguments दोहरा सकता है।
Court को यह देखना पड़ता है कि:
पहली petition का क्या हुआ और दूसरी बार bail मांगने के लिए क्या change in circumstances है?
Supreme Court ने बाद में इसी successive-bail aspect को गंभीरता से देखा।
High Court तक मामला कैसे पहुँचा?
दूसरी bail petition में Sukhwinder Singh ने मुख्य रूप से अपनी prolonged custody और trial की धीमी progress को सामने रखा।
उस समय तक:
- custody January 2024 से चल रही थी;
- charges July 2024 में frame हो चुके थे;
- 24 prosecution witnesses में केवल 2 examine हुए थे;
- trial के जल्दी खत्म होने की संभावना कम दिखाई दे रही थी।
Defence ने Article 21 के right to speedy trial पर जोर दिया।
इसके अलावा defence ने NDPS investigation/recovery से जुड़े कई objections भी उठाए।
लेकिन ध्यान रहे—इनमें से हर objection पर Supreme Court ने final finding नहीं दी।
यह distinction article में बहुत जरूरी है।
Accused / Respondent की दलील क्या थी?
Sukhwinder Singh की तरफ से argument का सबसे मजबूत हिस्सा यह था कि Section 37 को mechanical तरीके से पढ़कर Article 21 को practically निष्प्रभावी नहीं बनाया जा सकता।
Defence का broad counter था:
अगर accused लंबे समय से custody में है, charges frame हो चुके हैं, लेकिन trial बहुत धीमा है और prosecution evidence बेहद कम आगे बढ़ा है, तो constitutional liberty को भी Court को ध्यान में रखना होगा।
इसके साथ defence ने कुछ और points भी उठाए:
- NDPS Act की Sections 42, 50 और 52 के alleged violations;
- independent witness न होने का point;
- written grounds of arrest दिए जाने का issue;
- यह contention कि accused का कोई NDPS antecedent नहीं था;
- और co-accused को bail मिलने के कारण parity।
Written grounds of arrest के संबंध में defence ने Mihir Rajesh Shah v. State of Maharashtra और Dr. Rajinder Rajan v. Union of India पर reliance किया।
लेकिन आगे Supreme Court ने साफ किया कि इन merits-based contentions पर उस stage पर कोई final opinion नहीं दिया जा रहा था।
State का Counter क्या था?
अब State की तरफ से सबसे मजबूत objection सामने आया।
State ने कहा:
यह commercial quantity का NDPS case है।
इसलिए Section 37(1)(b)(ii) सीधे लागू होता है।
और Section 37 के तहत Court को bail देने से पहले दो cumulative conditions पर satisfaction record करनी ही होगी:
- reasonable grounds हों कि accused उस offence का guilty नहीं है; और
- bail पर रहते हुए उसके कोई offence करने की संभावना नहीं है।
State का कहना था कि High Court ने इन दोनों conditions पर कोई satisfaction record ही नहीं की।
इसके बजाय High Court ने Article 21 के speedy trial right को आधार बनाकर Section 37 की rigour को dilute कर दिया।
State ने Supreme Court के Narcotics Control Bureau v. Kashif, State of Meghalaya v. Lalrintluanga Sailo, Union of India v. Ajay Kumar Singh और Parwinder Singh v. State of Punjab जैसे decisions पर reliance किया।
यही State का central counter था:
“Article 21 important है, लेकिन Parliament ने commercial quantity NDPS cases के लिए Section 37 का special bail test बनाया है। High Court उसे हटाकर bail नहीं दे सकता।”
High Court ने क्या फैसला दिया और क्यों?
High Court ने 18 February 2026 को CRM-M No. 70945 of 2025 allow कर दी।
Sukhwinder Singh को regular bail मिल गई।
High Court के reasoning में कुछ factual points खास थे:
- accused लगभग 2 years, 1 month and 2 days से custody में था;
- charges 20 July 2024 को frame हुए थे;
- 24 prosecution witnesses में केवल 2 examine हुए थे;
- trial को considerable time लगने की संभावना थी;
- further incarceration को Article 21 के speedy-trial right के against माना गया।
और फिर High Court ने एक ऐसा observation किया जिसने इस पूरे case को Supreme Court तक पहुँचा दिया:
Section 37 NDPS Act की rigour को speedy-trial right को ध्यान में रखते हुए dilute किया जा सकता है।
यही sentence Supreme Court के सामने सबसे बड़ा legal fault-line बन गया।
High Court के इस reasoning में असली legal tension क्या था?
High Court के सामने एक वास्तविक constitutional problem थी।
एक तरफ:
Article 21 — personal liberty + speedy trial
दूसरी तरफ:
Section 37 NDPS Act — commercial quantity में कठोर bail conditions।
अगर trial बहुत धीमा है तो accused को indefinite custody में रखना भी Article 21 का सवाल बन सकता है।
लेकिन अगर Court केवल delay देखकर Section 37 की conditions को छोड़ दे, तो Parliament द्वारा बनाई गई special bail restriction का क्या होगा?
High Court ने liberty और delay को ज्यादा weight दिया।
State ने कहा कि statutory conditions को इस तरह dilute नहीं किया जा सकता।
अब Supreme Court को यह तय करना था कि इन दोनों को कैसे साथ पढ़ा जाए।
High Court के Order में एक और महत्वपूर्ण बात
Supreme Court ने केवल Section 37 का issue नहीं देखा।
उसने High Court के order को record के साथ मिलाकर भी देखा।
और यहाँ एक factual contradiction सामने आया।
High Court ने अपने order में यह record किया था कि Sukhwinder Singh “not involved in any other case”।
लेकिन Supreme Court ने bail petition itself देखी और पाया कि respondent ने उसमें एक दूसरे criminal case का admission किया था।
यानी:
bail petition में एक बात, High Court के order में दूसरी बात।
Supreme Court ने इस contradiction को simply clerical mistake मानकर छोड़ नहीं दिया।
Court ने इसे High Court के bail order की reliability और record consideration से जोड़कर देखा।
Successive Bail में दूसरा बड़ा सवाल
यह Sukhwinder Singh case का एक ऐसा point है जिसे सामान्य NDPS bail summary अक्सर छोड़ देगी।
यह दूसरी bail petition थी।
पहली petition 27 October 2025 को withdrawn हो चुकी थी।
दूसरी petition February 2026 में decide हुई।
Supreme Court ने देखा कि High Court के impugned order में यह पर्याप्त रूप से deal नहीं किया गया कि:
पहली bail petition का क्या हुआ और दूसरी bail petition में ऐसा कौन सा change in circumstance था जिससे fresh bail consideration justified हुई?
यह इसलिए महत्वपूर्ण है क्योंकि successive bail कोई बिल्कुल नया litigation universe नहीं होता।
पहले Court के सामने जो हुआ है, वह subsequent bail proceeding में relevant history बन जाता है।
Previous Bail का पूरा disclosure क्यों जरूरी है?
Supreme Court ने एक और rare point उठाया।
Bail petition में earlier cases/bail proceedings के case numbers का reference था, लेकिन उनके nature और outcome का पूरा disclosure नहीं था।
Court ने कहा कि खासकर Section 37 जैसे stringent statutory regime में Court के सामने complete candour होना चाहिए।
सिर्फ case number डाल देना और यह स्पष्ट न करना कि पिछली bail application का क्या outcome हुआ—Court को पूरी factual picture नहीं देता।
यानी:
Successive bail में disclosure सिर्फ formal compliance नहीं है।
Court को यह पता होना चाहिए कि accused पहले क्या मांग चुका है, उस पर Court ने क्या किया और अब कौन सा genuine change आया है।
यह इस judgment का एक अलग procedural lesson है।
Supreme Court तक मामला कैसे पहुँचा?
High Court के 18 February 2026 के bail order के खिलाफ State of Punjab Supreme Court पहुँचा।
Matter SLP (Crl.) No. 5020 of 2026 के रूप में आया।
25 March 2026 को Supreme Court ने notice issue किया और matter आगे सुनवाई के लिए रखा।
बाद में leave grant हुई और matter criminal appeal के रूप में decide हुआ।
Supreme Court की Bench में Justice Sanjay Karol और Justice Augustine George Masih थे।
Judgment/order 24 April 2026 को आया।
Supreme Court के सामने असली कानूनी सवाल क्या थे?
अब case को सही तरह से समझने के लिए सवालों को अलग-अलग रखना जरूरी है।
सवाल 1
Commercial quantity NDPS case में क्या Section 37(1)(b)(ii) की twin conditions mandatory हैं?
सवाल 2
क्या High Court bail देते समय उन दोनों conditions पर अपनी satisfaction record किए बिना bail दे सकता है?
सवाल 3
क्या prolonged custody और Article 21 के speedy-trial right के आधार पर Section 37 की statutory rigour को dilute किया जा सकता है?
सवाल 4
Successive bail petition में earlier bail application के fate और change in circumstances को Court के सामने disclose करना कितना महत्वपूर्ण है?
सवाल 5
अगर bail order में accused के antecedents के बारे में ऐसी बात record हो जो उसके अपने bail petition से contradict करती हो, तो क्या उस order को sustainable माना जा सकता है?
यही actual Supreme Court battle थी।
संबंधित Act और Sections क्या कहते हैं?
Section 37 NDPS Act — इस पूरे case की धुरी
Section 37 कुछ गंभीर NDPS offences के लिए bail को ordinary criminal law से अलग बनाता है।
Commercial quantity के मामले में Court को statutory restrictions का पालन करना पड़ता है।
Section 37(1)(b)(ii) के तहत Court को दो बातें satisfy करनी होती हैं:
पहली: reasonable grounds हों कि accused उस offence का guilty नहीं है।
दूसरी: Court को यह भी संतोष होना चाहिए कि bail पर रहते हुए accused के कोई offence करने की संभावना नहीं है।
दोनों conditions cumulative हैं।
एक condition पूरी करके दूसरी छोड़ नहीं सकते।
Supreme Court ने इसी को mandatory jurisdictional pre-condition माना।
Article 21 क्या कहता है?
Article 21 व्यक्ति की life and personal liberty की constitutional protection देता है।
इसी constitutional protection से speedy trial का अधिकार विकसित हुआ है।
इस case में accused ने इसी constitutional principle को अपने favour में इस्तेमाल किया:
अगर trial आगे ही नहीं बढ़ रहा, तो केवल statutory restriction के नाम पर व्यक्ति को लंबे समय तक custody में रखना उचित नहीं होना चाहिए।
यह argument अपने आप में कमजोर नहीं था।
Supreme Court ने भी Article 21 को “precious” constitutional right माना।
लेकिन Court ने आगे एक महत्वपूर्ण distinction किया:
Article 21 और Section 37 को एक-दूसरे के खिलाफ खड़ा करके नहीं पढ़ना है।
दोनों को harmoniously read करना है।
Supreme Court ने पुराने फैसलों को कैसे देखा?
Supreme Court ने Section 37 की mandatory nature को पहले के judgments के आधार पर reinforce किया।
Narcotics Control Bureau v. Kashif
इस decision में Court ने Section 37 की twin conditions पर satisfaction को mandatory बताया।
State of Meghalaya v. Lalrintluanga Sailo
इसने भी Section 37 की mandatory requirement को reinforce किया।
Union of India v. Ajay Kumar Singh
Section 37 की conditions और bail order में required satisfaction की importance फिर सामने आई।
Parwinder Singh v. State of Punjab
Punjab में drug menace को देखते हुए NDPS bail matters में courts को circumspect रहने की caution पर reliance किया गया।
इन judgments की list याद करने से ज्यादा महत्वपूर्ण यह है कि Supreme Court ने इन्हें High Court के actual bail order की language के खिलाफ test किया।
Supreme Court ने High Court की reasoning को कैसे परखा?
अब judgment का सबसे महत्वपूर्ण हिस्सा।
Supreme Court ने High Court के order को पढ़ा और देखा:
High Court ने bail देने के लिए Section 37 की twin satisfaction record नहीं की।
इसके बजाय उसने कहा कि speedy trial को ध्यान में रखते हुए Section 37 की rigour dilute की जा सकती है।
Supreme Court ने इसे settled law के खिलाफ माना।
Court ने साफ किया कि commercial quantity recovery वाले NDPS matter में Section 37 की conditions mandatory हैं।
इन conditions को record करना कोई procedural decoration नहीं है।
यह bail jurisdiction की mandatory pre-condition है।
अगर Court ने statutory satisfaction record ही नहीं की, तो bail order legally टिक नहीं सकता।
Article 21 को Supreme Court ने reject नहीं किया
यहाँ article में एक बहुत जरूरी distinction रखना होगा।
Supreme Court ने यह नहीं कहा:
“NDPS case में Article 21 लागू नहीं होता।”
ऐसा पढ़ना judgment को गलत समझना होगा।
Court ने Article 21 के speedy-trial right को स्वीकार किया।
लेकिन कहा कि commercial quantity NDPS case में इस constitutional right को Section 37 के statutory framework के भीतर exercise करना होगा।
यानी:
Article 21 बनाम Section 37 नहीं।
बल्कि:
Article 21 + Section 37 को harmoniously read करना है।
सिर्फ trial delay या prolonged custody को आधार बनाकर Section 37 की mandatory twin conditions को override नहीं किया जा सकता।
एक Rare Legal Point — “Delay” और “Statutory Bail Test” एक ही चीज नहीं हैं
यही इस judgment की सबसे महत्वपूर्ण lawyer-level learning है।
Accused की custody लंबी हो सकती है।
Trial धीमा हो सकता है।
Article 21 genuinely attract हो सकता है।
लेकिन Court को फिर भी पूछना पड़ेगा:
Section 37(1)(b)(ii) की दोनों conditions कहाँ satisfy होती हैं?
अगर Court ने उस statutory question का answer record ही नहीं किया, तो सिर्फ custody की length से bail order complete नहीं हो जाता।
यानी:
Long custody एक important fact है; वह Section 37 की mandatory satisfaction का substitute नहीं है।
यही Supreme Court के reasoning का core है।
एक और Rare Point — High Court की एक छोटी factual error भी क्यों भारी पड़ी?
High Court ने record किया कि Sukhwinder Singh किसी दूसरे case में involved नहीं था।
लेकिन उसकी own bail petition में एक दूसरे case का admission मौजूद था।
अब सामान्य litigation में कोई कह सकता है:
“एक factual discrepancy है, बाकी order तो सही है।”
लेकिन Supreme Court ने इसे isolated typo की तरह नहीं देखा।
क्यों?
क्योंकि bail discretionary relief है।
और Section 37 वाले case में Court को accused के antecedents और surrounding circumstances पर carefully apply mind करना होता है।
अगर order में ऐसा fact record हो जो record से ही contradict करता है, तो यह दिखाता है कि relevant material का proper consideration हुआ या नहीं, इस पर सवाल पैदा होता है।
इसलिए यह केवल “एक गलत line” नहीं रही।
यह bail order की judicial application of mind से जुड़ गई।
Previous Bail Disclosure — 3rd Rare Point
Successive bail में accused को Court के सामने साफ बताना चाहिए:
पहली bail कब मांगी थी?
किस ground पर?
क्या हुआ?
अब क्या बदला है?
Sukhwinder Singh की पहली bail petition withdrawn हुई थी।
लेकिन Supreme Court ने पाया कि subsequent bail proceedings में earlier proceeding के fate और nature का पर्याप्त disclosure नहीं हुआ।
Court ने साफ संकेत दिया कि Section 37 जैसे stringent regime में clean hands और complete candour और ज्यादा महत्वपूर्ण हो जाते हैं।
यानी:
Successive bail कोई “नई file खोलकर पुरानी history भूल जाने” वाली प्रक्रिया नहीं है।
पुरानी bail litigation की पूरी कहानी नई Court के सामने होनी चाहिए।
Accused ने Sections 42, 50 और 52 NDPS Act के violation की बात उठाई — Supreme Court ने क्या किया?
यहाँ हमें बहुत सावधान रहना है।
Defence ने इन procedural provisions के alleged violations की arguments रखीं।
Written grounds of arrest से संबंधित constitutional/statutory argument भी उठाया गया।
लेकिन Supreme Court ने इन points पर final adjudication नहीं की।
Court ने essentially कहा कि ये merits-based contentions fresh bail application में competent Court के सामने उठाए जा सकते हैं।
इसलिए हम article में यह नहीं लिखेंगे कि:
“Supreme Court ने माना कि Section 42/50/52 का violation नहीं हुआ।”
और यह भी नहीं लिखेंगे कि:
“Supreme Court ने माना कि violation हुआ।”
दोनों गलत होंगे।
सही बात:
ये arguments Supreme Court के सामने रखे गए थे, लेकिन इस appeal में Court ने उन merits को finally decide नहीं किया।
यही primary-record discipline है।
Supreme Court ने आखिर क्या फैसला सुनाया?
Supreme Court ने State की appeal allow कर दी।
High Court का 18 February 2026 का bail order set aside कर दिया।
Sukhwinder Singh को Trial Court के सामने एक सप्ताह के भीतर surrender करने का direction दिया गया।
लेकिन Court ने एक important liberty भी दी:
Surrender के बाद वह competent Court के सामने fresh regular bail application दाखिल कर सकता है।
इसलिए technically यह कहना सही नहीं होगा कि:
“Supreme Court ने Sukhwinder Singh को कभी bail नहीं मिल सकती कहा।”
Court ने सिर्फ High Court का वह particular bail order set aside किया जो Section 37 की mandatory conditions record किए बिना दिया गया था।
Fresh bail का रास्ता खुला रखा गया।
इस Judgment से कौन सा कानूनी सिद्धांत साफ हुआ?
Commercial quantity NDPS case में Section 37(1)(b)(ii) की twin conditions mandatory हैं।
Court को bail देते समय यह record करना होगा कि:
- reasonable grounds exist कि accused guilty नहीं है; और
- accused bail पर रहते हुए कोई offence नहीं करेगा।
इन conditions पर satisfaction record किए बिना bail order टिकाऊ नहीं है।
और केवल prolonged custody या Article 21 के speedy-trial right के आधार पर Section 37 की statutory requirement को mechanically dilute नहीं किया जा सकता।
Article 21 और Section 37 को harmoniously पढ़ना होगा।
इस फैसले का महत्वपूर्ण/दुर्लभ बिंदु जिसे नजरअंदाज नहीं करना चाहिए
इस judgment को अगर सिर्फ इस line में बदल दिया जाए:
“NDPS में Section 37 बहुत strict है।”
तो judgment की असली value खत्म हो जाएगी।
असल lesson तीन स्तरों पर है।
पहला — Statutory level
Section 37 की twin satisfaction mandatory है।
दूसरा — Constitutional level
Article 21 का speedy-trial right वास्तविक और महत्वपूर्ण है, लेकिन special NDPS regime को simply bypass करने का automatic route नहीं है।
तीसरा — Procedural level
Successive bail में previous bail history, disclosure और change in circumstances को ignore नहीं किया जा सकता।
इन तीनों को साथ पढ़ने पर judgment समझ आता है।
एक और Rare Observation — Bail Order की भाषा भी Evidence-जैसी जिम्मेदारी मांगती है
High Court ने order में “not involved in any other case” लिखा।
लेकिन bail petition में contrary admission था।
यह बताता है कि bail orders में factual recording कितनी महत्वपूर्ण है।
क्योंकि Court का bail order सिर्फ एक conclusion नहीं होता।
वह उस conclusion तक पहुँचने वाले relevant facts + statutory test + judicial satisfaction का record भी होता है।
अगर factual foundation गलत हो और statutory satisfaction भी absent हो, तो appellate Court के लिए intervention का ground मजबूत हो जाता है।
यह point केवल NDPS cases के लिए नहीं, बल्कि हर serious bail proceeding के लिए practical importance रखता है।
Final Result: कौन जीता और क्या हुआ?
इस appeal में State of Punjab सफल हुआ।
Supreme Court ने:
- High Court का 18 February 2026 का bail order set aside किया;
- Sukhwinder Singh @ Gora को एक सप्ताह के भीतर Trial Court के सामने surrender करने का direction दिया;
- और उसे surrender के बाद fresh regular bail application दाखिल करने की liberty दी।
लेकिन prosecution की guilt का final determination Supreme Court ने इस appeal में नहीं किया।
यानी:
Bail order गया — criminal trial जारी रहेगा।
और defence के जिन merits points पर Supreme Court ने final finding नहीं दी, वे fresh bail proceedings में competent Court के सामने उठाए जा सकते हैं।
कानूनी व्याख्या
Sukhwinder Singh judgment को समझने का सबसे सही तरीका यह है कि इसे “Article 21 हार गया और Section 37 जीत गया” जैसी binary कहानी न बनाया जाए।
Supreme Court ने Article 21 को खत्म नहीं किया।
Court ने Section 37 को भी absolute constitutional shield नहीं बनाया।
Court ने दोनों के बीच एक statutory-constitutional relationship तय किया:
Speedy trial जरूरी है।
लेकिन commercial quantity NDPS case में bail देते समय Court को Section 37 की mandatory conditions से गुजरना ही होगा।
अगर trial बहुत धीमा है, तो वह Article 21 का गंभीर सवाल हो सकता है।
लेकिन bail order में फिर भी Court को यह दिखाना होगा कि Section 37 की conditions किस आधार पर satisfy हुईं।
इस case में High Court ने उस mandatory satisfaction को record नहीं किया।
उल्टा उसने Section 37 की rigour को Article 21 के आधार पर dilute करने की बात कही।
Supreme Court ने यही approach अस्वीकार की।
और यही कारण है कि High Court का bail order टिक नहीं सका।
इस Judgment का Practical Meaning
अगर commercial quantity NDPS case में कोई accused लंबे समय से custody में है और trial धीमा है, तो Article 21 का argument खत्म नहीं हुआ है।
लेकिन केवल यह कहना:
“मैं दो साल से जेल में हूँ, इसलिए bail दे दीजिए”
Section 37 वाले case में पर्याप्त नहीं होगा।
Court को देखना पड़ेगा:
- Section 37 की twin conditions;
- prosecution material;
- accused की alleged role;
- antecedents;
- previous bail history;
- change in circumstances;
- trial progress;
- और Article 21 का speedy-trial concern।
और successive bail में पहली bail petition का पूरा history disclose करना भी अत्यंत महत्वपूर्ण है।
इस judgment की सबसे practical सीख यही है:
Special statute के खिलाफ constitutional right को खड़ा करने के बजाय दोनों को एक साथ पढ़ना होगा।

Supreme Court record में matter State की उस challenge से आया जिसमें Punjab & Haryana High Court के 18 February 2026, CRM-M No. 70945/2025 के bail order को चुनौती दी गई थी।

1. क्या commercial quantity NDPS case में Article 21 के आधार पर Bail मिल सकती है?
State of Punjab v. Sukhwinder Singh @ Gora, 2026 INSC 411 में Supreme Court ने कहा कि Article 21 का speedy-trial right महत्वपूर्ण है, लेकिन commercial quantity NDPS case में उसे Section 37 NDPS Act के statutory framework के साथ पढ़ना होगा। केवल prolonged custody या trial delay के आधार पर Section 37 की mandatory twin conditions को override नहीं किया जा सकता।
2. Section 37 NDPS Act की twin conditions क्या हैं?
Sukhwinder Singh judgment के अनुसार commercial quantity मामले में bail देने से पहले Court को reasonable grounds के आधार पर यह satisfaction record करनी होती है कि accused guilty नहीं है और bail पर रहते हुए उसके कोई offence करने की संभावना नहीं है। Supreme Court ने इन दोनों conditions को cumulative और mandatory माना।
3. क्या केवल लंबे समय तक जेल में रहने से NDPS में Bail मिल जाती है?
नहीं। Sukhwinder Singh v. State of Punjab, 2026 INSC 411 में accused दो साल से अधिक custody में था और trial में 24 में से केवल 2 prosecution witnesses examine हुए थे। फिर भी Supreme Court ने कहा कि सिर्फ delay/prolonged incarceration के आधार पर Section 37 की mandatory requirements को dilute नहीं किया जा सकता।
4. Sukhwinder Singh को High Court ने Bail क्यों दी थी?
Punjab & Haryana High Court ने 18 February 2026 को regular bail देते समय prolonged custody, charges frame होने के बावजूद trial की धीमी progress, केवल 2 of 24 witnesses की examination और Article 21 के speedy-trial right को महत्व दिया था। High Court ने कहा था कि इन परिस्थितियों में Section 37 की rigour को dilute किया जा सकता है। Supreme Court ने इसी approach को statutory law के विपरीत माना।
5. Supreme Court ने High Court का Bail Order क्यों रद्द किया?
मुख्य कारण यह था कि High Court ने Section 37(1)(b)(ii) की twin conditions पर mandatory satisfaction record नहीं की थी। इसके बजाय उसने Article 21 के speedy-trial concern को आधार बनाकर Section 37 की rigour को dilute किया। Supreme Court ने इसे settled law के contrary माना और bail order set aside कर दिया।
6. क्या Sukhwinder Singh की पहली Bail Application भी थी?
हाँ। CRM-M No. 58082 of 2025 के रूप में पहली regular bail application दाखिल हुई थी, जिसे 27 October 2025 को withdrawn किया गया। इसके बाद CRM-M No. 70945 of 2025 दूसरी bail petition थी, जिसे High Court ने 18 February 2026 को allow किया था। Supreme Court ने successive bail की इस history को भी महत्वपूर्ण माना।
7. Previous Bail Application छिपाने या पूरा Disclosure न करने का क्या असर हो सकता है?
Sukhwinder Singh judgment में Supreme Court ने कहा कि Section 37 जैसे stringent statutory regime में Court के सामने complete candour जरूरी है। केवल previous proceedings के case numbers बताना और उनके nature/outcome को स्पष्ट न करना Court को पूरी factual picture नहीं देता। Successive bail में previous bail का fate और genuine change in circumstances महत्वपूर्ण हैं।
8. क्या Supreme Court ने Section 42, 50 और 52 NDPS Act के alleged violations पर फैसला दिया?
नहीं। ये arguments accused की ओर से रखे गए थे, लेकिन Supreme Court ने इस appeal में इन merits-based contentions पर final opinion नहीं दिया। Court ने संकेत दिया कि fresh bail application में competent Court के सामने ये points उठाए जा सकते हैं। इसलिए इस judgment को उन provisions के compliance पर final ruling के रूप में नहीं पढ़ना चाहिए।
9. क्या Supreme Court ने Sukhwinder Singh को हमेशा के लिए Bail से रोक दिया?
नहीं। Supreme Court ने High Court का 18 February 2026 का bail order set aside किया और Sukhwinder Singh को Trial Court के सामने एक सप्ताह में surrender करने को कहा। साथ ही Court ने साफ liberty दी कि surrender के बाद वह competent Court के सामने fresh regular bail application दाखिल कर सकता है।
10. इस Judgment का सबसे महत्वपूर्ण practical legal point क्या है?
इस case में सबसे महत्वपूर्ण बात यह है कि commercial quantity NDPS case में Article 21 और Section 37 को एक-दूसरे का alternative नहीं बनाया जा सकता। Court को speedy trial के constitutional concern को देखना है, लेकिन bail देते समय Section 37 की mandatory twin satisfaction भी record करनी होगी। साथ ही successive bail में previous bail history और material facts का complete disclosure करना जरूरी है।
